This End User License Agreement ("EULA") is a legal agreement between you and Dream Forge Mobile Pte. Ltd. ("we," "our," or "us") for the KYZO mobile application and any related services ("App"). By downloading, installing, or using the App, you agree to this EULA. This EULA supplements our Terms of Service and Privacy Policy; if there is a conflict regarding your software license or subscription, this EULA controls.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any device that you own or control, solely for your personal, non-commercial use, in accordance with the usage rules of the applicable app store (Apple App Store or Google Play).
2. Auto-Renewable Subscriptions
The App offers auto-renewable subscriptions that unlock premium features. The following terms apply:
- Billing: Payment is charged to your Apple App Store or Google Play account upon confirmation of purchase.
- Free trial (if offered): If you do not cancel before the trial ends, it automatically converts to a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
- Auto-renewal: Subscriptions renew automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal charge: Your account is charged for renewal within 24 hours prior to the end of the current period.
- Managing & cancelling: You can manage or cancel your subscription in your device's App Store or Google Play account settings after purchase. Deleting the App does not cancel a subscription.
- Pricing: Prices are stated in the App and may vary by region and change over time, subject to applicable notice.
- Refunds: Refunds, where available, are handled under the policies of the Apple App Store or Google Play Store.
3. Restrictions
You may not, and may not permit others to:
- Copy, modify, or create derivative works of the App
- Reverse-engineer, decompile, or disassemble the App, except as permitted by law
- Rent, lease, lend, sell, sublicense, or distribute the App
- Remove or alter any proprietary notices
- Use the App in any unlawful manner or in violation of app store rules
4. Ownership
The App is licensed, not sold. We and our licensors retain all right, title, and interest in and to the App, including all intellectual property rights.
5. Health & AI Disclaimer
The App is for general wellness and informational purposes only and is not a medical device. It does not provide medical advice, diagnosis, or treatment, and AI-generated content may be inaccurate. See the Health & Medical Disclaimer in our Terms of Service.
6. Apple App Store — Additional Terms
If you obtained the App from the Apple App Store, the following additional terms apply:
- Acknowledgement: This EULA is between you and Dream Forge Mobile only, and not with Apple. Apple is not responsible for the App or its content.
- Scope of License: The license is limited to use on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
- Maintenance & Support: Dream Forge Mobile, not Apple, is solely responsible for providing any maintenance and support for the App.
- Warranty: Dream Forge Mobile is solely responsible for any product warranties, whether express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product Claims: Dream Forge Mobile, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and consumer protection claims.
- Intellectual Property: Dream Forge Mobile, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to the App.
- Third-Party Beneficiary: You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you.
- Legal Compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
7. Google Play — Additional Terms
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Subscriptions purchased through Google Play are managed in your Google Play account, and Google Play's refund policies apply.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, Dream Forge Mobile shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
10. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies.
11. Governing Law
This EULA is governed by the laws of the Republic of Singapore, without regard to conflict of law provisions, except where the app store's terms or your local mandatory consumer law require otherwise.
